I have proved … that commerce, independently of the service rendered by the material fact of transportation, is in itself a direct spur to consumption, and therefore a cause of further production, a principle of the creation of values.

At first this may seem paradoxical, but it has been demonstrated by economic analysis: the metaphysical act of exchange, in addition to labor, but by a different method from labor, is a producer of real value and of wealth. Furthermore, this assertion will astonish nobody who reflects that production or creation signifies only change of form, and that therefore creative forces, labor itself, are immaterial. So that the merchant who has enriched himself by real speculation, without usurious profit, enjoys the fortune which he has acquired by a perfectly just title: his fortune is as legitimate as that which labor has produced. And pagan antiquity, as well as the Church, has unjustly aspersed commerce, upon the pretext that its rewards were not the remuneration of real services. Once again, Exchange, an entirely immaterial operation, which is accomplished by the reciprocal consent of the parties, cost and distance of transportation being allowed for, is not merely a transposition or substitution, it is also a creation.

Commerce, then, being in itself a producer of wealth, men have engaged in it with ardor in all ages; no need for the legislator to preach its advantages and to recommend the practice of it. Let us suppose, what is not an absolutely absurd supposition, that commerce did not exist, that with our vast means of industrial execution, we had no idea of exchange: it is easy to see that if some one should come to teach men to exchange their products and trade among themselves, he would be rendering them an immense service. The history of humanity mentions no revolutionary who could compare with such an one. The remarkable men who invented the plough, the vine, wheat, did not rank above him who first invented commerce.

… Do you have it yet? If not, here’s another clue. It’s the same author who said this, later in the same work:

You say that you will make but few laws; that you will make them simple and good. That is indeed an admission. The Government is indeed culpable, if it avows thus its faults. No doubt the Government will have engraved on the front of the legislative hall, for the instruction of the legislator and the edification of the people, this Latin verse, which a priest of Boulogne had written over the door to his cellar, as a warning to his Bacchic zeal:

Pastor, ne noceant, bibe pauca sed optima vina. [Pastor, for your health, drink but little wine, but of the best.]

Few laws! Excellent laws! It is impossible. Must not the Government regulate all interests, and judge all disputes; and are not interests, by the nature of society, innumerable; are not relations infinitely variable and changeable? How then is it possible to make few laws? How can they be simple? How can the best law be anything but detestable?

You talk of simplification. But if you can simplify in one point, you can simplify in all. Instead of a million laws, a single law will suffice. What shall this law be? Do not to others what you would not they should do to you: do to others as you would they should do to you. That is the law and the prophets.

But it is evident that this is not a law; it is the elementary formula of justice, the rule of all transactions. Legislative simplification then leads us to the idea of contract, and consequently to the denial of authority. In fact, if there is but a single law, if it solves all the contradictions of society, if it is admitted and acceptedby everybody, it is sufficient for the social contract. In promulgating it you announce the end of government. What prevents you then from making this simplification at once?

One more clue? Later in the same work, the same author wrote:

To be GOVERNED is to be kept in sight, inspected, spied upon, directed, law-driven, numbered, enrolled, indoctrinated, preached at, controlled, estimated, valued, censured, commanded, by creatures who have neither the right, nor the wisdom, nor the virtue to do so…. To be GOVERNED is to be at every operation, at every transaction, noted, registered, enrolled, taxed, stamped, measured, numbered, assessed, licensed, authorized, admonished, forbidden, reformed, corrected, punished. It is, under the pretext of public utility, and in the name of the general interest, to be placed under contribution, trained, ransomed, exploited, monopolized, extorted, squeezed, mystified, robbed; then, at the slightest resistance, the first word of complaint, to be repressed, fined, despised, harassed, tracked, abused, clubbed, disarmed, choked, imprisoned, judged, condemned, shot, deported, sacrificed, sold, betrayed; and, to crown all, mocked, ridiculed, outraged, dishonored. That is government; that is its justice; that is its morality. And to think that there are democrats among us who pretend that there is any good in government; Socialists who support this ignominy, in the name of Liberty, Equality, and Fraternity; proletarians who proclaim their candidacy for the Presidency of the Republic!

The author is Pierre-Joseph Proudhon (1809–1865), the French mutualist and revolutionary socialist, and the first political theorist to describe himself as an Anarchist. The work is his 1851 treatise, General Idea of the Revolution in the Nineteenth Century (as translated by John Beverly Robinson in 1923), in which Proudhon argued that the abolition of all coercive government and the emergence of a decentralized, mutualist economic order were the tacit principles underlying the French Revolution. The completion of the Revolution in the nineteenth century would mean an explicit struggle for these principles and an end to the half-way measures of constitutionalism, liberal republicanism, and representative government: the point was not to constrain authority, or put it under the control of the majority, but rather to end it.

From both an anarchist standpoint and a feminist standpoint, it’s an interesting and maddening work — like a strobe light alternating flashes of brilliance with utter darkness from one section to the next, and sometimes from one sentence to the next. But in any case, it’s interesting, and if you can avoid cognitive seizures, it’s well worth a careful reading.

The reason that I mention all this — other than the interest of the quotations themselves — is that (as Roderick was vexed to find out a couple months ago), you couldn’t find General Idea of the Revolution online for love or money. I have a new project. It’s a weblog called Dulce Et Decorum Est.

The means my ends will be anti-war cultural artefacts, both historical and contemporary. I don’t just mean agitprop by anti-war activists; I also mean artefacts that record the experiences of ordinary soldiers and civilians in times of war. This is not the place to go for commentary, analysis, or debate on current events; more or less none of the content will even be original to this website. It will be a place for facts, and for things, and for people. My intent is simply to remember our history (including the history we are making right now), and in so doing to strip the mask from off the War Party, revealing not glory, not honor, not heroism, but rather a grinning Death’s Head underneath.

I’ve been meaning to take note of the Directors’ Guild’s recent triumph over insurgent customers for a few days now:

A federal judge has issued final cut to studios, ruling that companies that snip out potentially offending material from movies for home viewing violate copyright laws.

Businesses that edit sex, profanity and violence out of DVD and VHS copies in an appeal to some viewers’ tastes are illegitimate, said Richard P. Matsch of U.S. District Court in Denver.

Four companies that do so must stop and turn over their copies of expurgated films to Hollywood’s major studios.

Audiences can now be assured that the films they buy or rent are the vision of the filmmakers who made them and not the arbitrary choices of a third-party editor, Directors Guild of America President Michael Apted said in a statement.

The studios and several prominent directors — including Steven Spielberg, Robert Altman and Steven Soderbergh — have been fighting movie sanitizers in court since 2002, saying that retailers such as CleanFlicks had no right to copy and distribute their own versions.

Retailers asserted that their cleaned-up copies made fair use of the movies under copyright law and that they bought one copy of the original for each modified version they rented or sold. That ensured more sales and exposure than such movies would have received had they not been edited to be more wholesome, the retailers argued.

We’re disappointed, CleanFlicks Chief Executive Ray Lines said. This is a typical case of David versus Goliath, but in this case, Hollywood rewrote the ending. We’re going to continue to fight.

As many as 90 video stores nationwide — about half of them in Utah, where CleanFlicks is based — purchase movies from his company, Lines said.

The owner of the four CleanFlicks shops in Utah County, Daniel Thompson, told the Deseret Morning News of Salt Lake City: I think it’s ridiculous that you can’t watch a movie without seeing sex, nudity or extreme violence. I don’t understand why they’re trying to keep that in there.

The dispute is about artistic integrity, said Apted, who directed Coal Miner’s Daughter.

Directors put their skill, craft and often years of hard work into the creation of a film, he said in the statement. So we have great passion about protecting our work, which is our signature and brand identification, against unauthorized editing.

My God, it’s a good thing we have the federal courts there to stand athwart our DVD players shouting No! If the judicial branch of the government weren’t there to keep customers from going around watching films any old way they want–if the federal judiciary weren’t there to force Mormon families to look at boobies and guns the way the Directors’ Guild authorized them to do–then who would? It’d be mere anarchy!

The latest technological weapons may have been taken out of the hands of viewers, but it is still a dangerous world for artistes. Viewers will find all kinds of improvised devices for skipping over sex and violence. Perhaps with faith and perserverance the Directors’ Guild can convince the courts to further protect their artistic vision, by having all the fast-forward buttons in America stuck in place with super-glue.

A poem for Nepal

It might not seem like a poetry reading from Rudyard Kipling is the most promising way to commemorate ongoing events in South Asia. But, by jingo, he did turn a good one out in protest of the Boer War; and the Ministry of Culture for this secessionist republic of one would like to offer it in honor of recent events, and in recognition of the danger posed by Geyanendra’s moves toward restoring his political patronage to would-be opposition leaders, in an effort to buy off the opposition. This may also have some application to other deciders I could mention, beyond the Himalayas.

The Old Issue

October 9, 1899

HERE is nothing new nor aught unproven, say the Trumpets,
Many feet have worn it and the road is old indeed.
It is the King–the King we schooled aforetime!

Prior restraint

Is there anything as ridiculous and petty, in the end, as the arrogance of power?

But it was a different story when Westword and then the Rocky Mountain News published more extensive excerpts from Harris’s writings. The excerpts showed that Harris had developed detailed plans to attack the school a year in advance, while he was in a juvenile diversion program and supposedly being investigated for building pipe bombs and making death threats (I’m Full of Hate and I Love It, December 6, 2001). Now officials were outraged that their top-secret investigation had sprung yet another leak.

So was the Denver Post. Tired of getting its ass whupped in the leak department, the Post went to court to demand the release of the rest of the materials seized from the killers’ homes. Attorneys for the county and the killers’ parents responded with a flurry of dire warnings about copycat effects, including one from David Shaffer, a psychiatrist and expert on adolescent suicide. In addition to a 27-page resumé, Shaffer submitted a four-page affidavit asserting the toxic nature of the basement tapes, which he hadn’t seen.

Some judges involved in the Columbine litigation have uncritically embraced the copycat argument, saying the disclosure of the materials would have a potential for harm or, in fact, would be immensely harmful to the public. [District Judge Brooke Jackson], who ultimately may have to decide the matter, has been more skeptical. In one hearing on the basement tapes, he pointed out that there were plenty of Columbine imitators before the existence of the tapes was even disclosed. All the more reason, [Assistant County Attorney Lily Oeffler] responded, not to release them.

What evidence do you have today that release of the documents is going to cause some calamity, or are we just speculating? Jackson demanded.

Unless you release the evidence and they actually cause the calamity, Your Honor, the question cannot be responded to, Oeffler shot back.

Does that mean I can’t, and no court can ever release them because maybe some additional copycat is going to be inspired?

I don’t think it is a maybe, Your Honor, Oeffler responded gravely.

It’s hard not to find the whole thing grimly funny, and not just because the Oeffler sounds exactly like the sort of name Dr. Seuss would invent for some otherwise anonymous, off-screen minion of paternalistic censorship. And then, just to add insult to injury, there’s this:

One proposed solution to the question of the killers’ tapes and writings, advanced by Ken Salazar before he left the post of Colorado attorney general for the U.S. Senate, was to turn over the materials to a qualified professional, who would author a study about the causes of Columbine while keeping the primary materials in strict confidence. The proposal soon fell apart, though, after the killers’ parents refused to cooperate with Salazar’s anointed expert, Del Elliott, director of the University of Colorado’s Center for the Study and Prevention of Violence.
