Patents kill

So, it turns out that today is–by edict of WIPOWorld Intellectual Property Day 2005. Among the objectives set out for the day are:

  • To increase understanding of how protecting IP rights helps to foster creativity and innovation;
  • To raise awareness of the importance in daily life of patents, copyright, trademarks and designs.

Well, who could disagree with such educational goals? The Ministries of Culture and Science in this secessionist republic of one applaud the educational purposes of World Intellectual Property day, and offer the following in the effort to raise awareness of the importance in daily life of patents and copyrights, and to make sure that you understand exactly how protecting IP restrictions is fostering creativity and innovation.

Intellectual property restrictions are government-granted monopolies. They have nothing, actually, to do with property rights; what they do is seize ordinary people’s property and hold it hostage to the license-holders’ demands for ransom. They kill innovation because they kill new products; they kill new products because they invade other people’s real property — meaning pens, paper, scanners, computers, DVD players, and so on — in the attempt to lock down ideas — which are, by nature, non-rivalrous resources; this amounts to nothing less than a systematic and ruthless intellectual enclosure movement against what is and ought to be the common property of all humanity.

Now, as a techno-geek, I don’t like how this strangles the amazing innovation that we could be seeing in the intelligent use of audio, video, and text content, in this age of cheap computers and plentiful storage. But the plain fact is that this isn’t, really, about what your latest gizmo can or can’t do with your music library, and it’s not a topic for polite debate and economic wonkery. This is life and death. For example, in India recently:

India, a major source of inexpensive AIDS drugs, passed a new patent law yesterday that groups providing drugs to the world’s poorest patients fear will choke off their supply of new treatments.

The new law, amending India’s 1970 Patent Act, affects everything from electronics to software to medicines, and has been expected for years as a condition for India to join the World Trade Organization.

But because millions of poor people in India and elsewhere — including by some estimates half the AIDS patients in the Third World — rely on India’s generic drug industry, lobbyists for multinational drug companies as well as activists fighting for cheap drugs had descended on New Delhi to try to influence the outcome.

It’s very disappointing, but it could have been worse, said Daniel Berman, a coordinator of the global access campaign for the medical charity Doctors Without Borders. All generics could have been removed from the market.

Instead, all the generic drugs already approved in India can still be sold, though sellers must now pay licensing fees. There are also provisions allowing companies that make generics to copy drugs in the future.

But there are relatively tough criteria for such copying, and activists predicted that prices for newly invented drugs will be much higher, because drug makers will have the same 20-year patent monopolies as they have in the West. As AIDS patients develop resistance to old drugs, new treatments will become less affordable, they said.

In addition, it is unclear whether makers of generic drugs in other countries, like Brazil, China and Thailand, will fill any increasing demand for cheaper medicines.

All Western countries grant product patents on new inventions. Since 1970, India has granted process patents, which allow another inventor to patent the same product as long as it was created by a novel process. In pharmaceuticals, that has meant that a tiny tweak in the synthesis of a molecule yields a new patent. Several companies can produce the same drug, creating competition that drives down prices.

Before 1970, India’s patent laws came from its colonial days, and it had some of the world’s highest drug prices. Process patents on drugs, fertilizers and pesticides have extended life expectancy and ended regular famines.

In Africa, exports by Indian companies, especially Cipla and Ranbaxy Laboratories, helped drive the annual price of antiretroviral treatment down from $15,000 per patient a decade ago to about $200 now. They also simplified therapy by putting three AIDS drugs in one pill. Dr. Yusuf Hamied, Cipla’s chairman, called the new law a very sad day for India.

And the same folks want to do the same thing to Latin America, through the adoption of CAFTA:

Found to be HIV-positive shortly before her husband died of AIDS-related complications last fall, an ailing Garcia was convinced of her own death sentence. But generic drugs have kept the virus in check and restored 60 lost pounds to her frame.

I now have hope, said the 52-year-old grandmother and flower vendor, who gets her medicine free from a nonprofit clinic.

Public health experts fear that hope might fade for Garcia and thousands of the region’s chronically ill if the Dominican Republic-Central American Free Trade Agreement, known as CAFTA, is approved this year.

Under the pact American pharmaceutical giants would gain a five-year edge on the development of new drugs by low-cost competitors. Generic versions of name-brand drugs are the main weapon for battling the AIDS pandemic in the developing world.

Healthcare activists say those intellectual property protections would drive up the cost of treating chronic conditions, particularly HIV/AIDS, sufferers of which routinely develop resistance to old medications. About 40 million people worldwide are infected with HIV, the virus that causes AIDS, and more than 275,000 of them live in the six Latin American CAFTA nations, according to United Nations statistics.

Patents kill people. They mean that the pharmaceutical cartel can call up the armed bully-boys of almost every government in the world in order to enforce artificially high prices for their top money-makers; and that means that State violence is being used to prevent affordable, life-saving drugs from reaching the desparately poor of the world. The multilateral so-called free trade agreements of the past couple decades — NAFTA, the WTO, and upcoming plans such as CAFTA and the FTAA — are slowly cutting back on traditional industrial protectionism while dramatically expanding the scale, scope, and deadly reach of intellectual protectionism.

To hell with that. Intellectual property is not about incentivizing or encouraging or opportunities. It’s about force: invading other people’s property to force them to render long-term rents to you long after you have stopped putting any particular work into what you’re claiming to be yours. A necessary corollary is that it also means invading those who offer innovations based on the work that you have done unless those innovations comply with a very narrow set of guidelines for authorized use. You have no right to do that, and you sure don’t have the right to do it at the expense of innocent people’s lives. A free society needs a free culture. Patents kill and freedom save people’s lives. Saturday Poetry Blogging: Psalm 126

April is the poet’s month.

While this secessionist republic of one normally adheres to a strict separation of Church and State, the Ministry of Culture has somewhat looser rules, and in honor of the first day of Passover (which begins at sundown this evening), this weekend’s poem is the 126th Psalm, the song of the returned exiles, a song of ascents. Variations on the Psalm are a common part of the Haggadah used for Passover seders. (Sidebar: you might also be interested to read Leona Green’s The Haggadah Revisited, one woman’s story of her search for a feminist Haggadah.)

I’ve used the New Jerusalem Bible translation here because that is my favorite of the ones that I had around the house. Note that if you were singing aloud this at Passover, you would (among other things) say Adonai, not YHWH.

Psalm 126

When YHWH brought back Zion’s captives,
we lived in a dream
then our mouths filled with laughter,

Sunday Poetry Blogging: Immoral (2002)

April is the poet’s month.

I wanted to post something by Andrea Dworkin this weekend; I know that she wrote poetry, but I don’t know where to find most of it. The published works that I’m familiar with are prose: essays, short stories, novels. Her writing is poetic wherever she writes, but I wanted something in verse. Since I couldn’t find anything in print and my resources for really looking for it are limited, I decided to go with this. I don’t know whether this counts as poetry or not, properly speaking; I do know that it is exactly right. This is from Heartbreak (2002), her memoir and the last book that she finished before she died.

IMMORAL

People play life as if it’s a game, whereas each step is a real step. The shock of being unable to control what happens, especially the tragedies, overwhelms one. Someone dies; someone leaves; someone lies. There is sickness, misery, loneliness, betrayal. One is alone not just at the end but all the time. One tries to camouflage pain and failure. One wants to believe that poverty can be cured by wealth, cruelty by kindness; but neither is true. The orphan is always an orphan.

The worst immorality is in apathy, a deadening of caring about others, not because they have some special claim but because they have no claim at all.

The worst immorality is in disinterest, indifference, so that the lone person in pain has no importance; one need not feel an urgency about rescuing the suffering person.

The worst immorality is in dressing up to go out in order not to have to think about those who are hungry, without shelter, without protection.

The worst immorality is in living a trivial life because one is afraid to face any other kind of life–a despairing life or an anguished life or a twisted and difficult life.

The worst immorality is in living a mediocre life, because kindness rises above mediocrity always, and not to be kind locks one into an ethos of boredom and stupidity.

The worst immorality is in imitating those who give nothing.

The worst immorality is in conforming so that one fits in, smart or fashionable, mock-heroic or the very best of the very same.

The worst immorality is accepting the status quo because one is afraid of gossip against oneself.

The worst immorality is in selling out simply because one is afraid.

The worst immorality is a studied ignorance, a purposeful refusal to see or know.

The worst immorality is living without ambition or work or pushing the rest of us along.

The worst immorality is being timid when there is no threat.

The worst immorality is refusing to push oneself where one is afraid to go.

The worst immorality is not to love actively.

The worst immorality is to close down because heartbreak has worn one down.

The worst immorality is to live according to rituals, rites of passage that are predetermined and impersonal.

The worst immorality is to deny someone else dignity.

The worst immorality is to give in, give up.

The worst immorality is to follow a road map of hate drawn by white supremacists and male supremacists.

The worst immorality is to use another person’s body in the passing of time.

The worst immorality is to inflict pain.

The worst immorality is to be careless with another person’s heart and soul.

The worst immorality is to be stupid, because it’s easy.

The worst immorality is to repudiate one’s own uniqueness in order to fit in.

The worst immorality is to set one’s goals so low that one must crawl to meet them.

The worst immorality is to hurt children.

The worst immorality is to use one’s strength to dominate or control.

The worst immorality is to surrender the essence of oneself for love or money.

The worst immorality is to believe in nothing, do nothing, achieve nothing.

The worst immoralities are but one, a single sin of human nothingness and stupidity. “Do no harm” is the counterpoint to apathy, indifference, and passive aggression; it is the fundamental moral imperative. “Do no harm” is the opposite of immoral. One must do something and at the same time do no harm. “Do no harm” remains the hardest ethic.

Saturday Poetry Blogging: Ozymandias (1818)

DED Space 2005-04-01 reminds us that April is National Poetry Month. A lot of the literati these days seem to think that contemporary poetry is a lost cause. I don’t know that that’s true at all; but even if it were, it would, at the most, be a good argument for promoting the poetry of the past until our contemporaries get back up to speed again. Just because something’s out of copyright doesn’t mean it’s not good anymore, and just because something’s new doesn’t mean that it’s therefore more worth running in your journals and lit mags than something old.

So, in honor of the event, the Ministry of Culture in this secessionist republic of one will be reprinting poetry throughout the month. Since Yazad reminded me how good it is just a couple of months ago, we’ll begin today with Ozymandias (1818), by Percy Bysshe Shelley. Enjoy:

I met a traveller from an antique land

Feminist Bloggers on the Air

A fist in the air today for Feminist Blogs contributors DED Space and media girl, who had selections from their posts And the show goes on and Spam for life read on the air on national television (!), as part of the Inside the Blogs segment on CNN’s Inside Politics. Rock on.

Check it out. Other than having to hear the word blogosphere–probably the most wince-worthy neologism in the world today–pronounced aloud for the first time, I had a blast listening to it.

I don’t have a teevee these days, so I don’t get much of a chance to follow the ins and outs at CNN or Fox News. But I gather this is a short segment run on one of CNN’s daily commentary shows. Yeah, that’s only a couple of minutes a day, but it is and ought to be exciting. Tom Tomorrow was exactly right just about this time two years ago when he smacked blog-triumphalists upside the head and pointed out that the relationship of bloggers to the mainstream media is roughly that of wood tick to deer. That’s still mostly true now, but we are seeing the first creaks and whispers of a change in front of our eyes. CNN is beginning to pull material from blogs because that’s just as easy, or even easier to do than churn out more of the same commentary from the same set of blowhard usual suspects. Thus two feminist bloggers got some recognition that they deserve as much as anyone, and a lot more than the blowhard set that usually gets air time on CNN.

The more DIY media that people produce, and make freely available for re-use, the more that turning to grassroots media will become the path of least resistence. This is not about to revolutionize media; it’s unlikely to even reform it much in the immediate future. But it is a step in the right direction and it is exciting to see writing that used to exist strictly as marginalia on mainstream media discussions begin to enter, step by step, into the conversation.

Become the media.
