May Day 2008

Today is May Day, or International Workers’ Day, a holiday created by Chicago workers–most of them anarchists–to honor the memory of the Haymarket martyrs and to celebrate the struggle of workers for freedom, for a better life, and for control over the conditions of their own labor. It was created during the radical phase of the struggle for an eight-hour day: after legislative campaigns by the Knights of Labor and the National Labor Union failed, labor radicals in Chicago — organizers like Albert Parsons, Lucy Parsons, August Spies — declared that workers should take matters into their own hands, in the form of direct action on the shop floor. Workers would no longer try to get an eight-hour day by promising a useful and compliant voter base in return for patronage from politicians. To get an eight-hour shift, workers would make their own: in many shops, workers in the International Working People’s Association would bring their own whistle to work and blow it at the end of an eight hour shift — at which point most or all of the workers on the floor would just get up and just walk off, like the free people they were, whether or not the boss demanded more hours of labor. At the height of the struggle, they organized a General Strike, in defiance of the bosses and in spite of repeated violence from the Law.

Today is also the third annual day of rallies, strikes and marches against the criminalization of immigrant workers. A day which immigrant workers have chosen for actions against the bigotry of nativist bullies, the violence of La Migra, and the political system of international apartheid, as contemptible as it is lethal. A day to proudly proclaim We are not criminals and We are not going anywhere, to demand the only political program that recognizes it — open borders and unconditional amnesty for all undocumented workers.

And it is a joy for me to read that today is also a day of strikes against the bosses’ war in Iraq, which will shut down all the sea ports on the west coast of the United States, as an act of defiance against the State war machine and against the worthless political opportunists who promise to end it while voting, over and over again, to sustain it:

Amid this political atmosphere, dockworkers of the International Longshore and Warehouse Union have decided to stop work for eight hours in all U.S. West Coast ports on May 1, International Workers’ Day, to call for an end to the war.

This decision came after an impassioned debate where the union’s Vietnam veterans turned the tide of opinion in favor of the anti-war resolution. The motion called it an imperial action for oil in which the lives of working-class youth and Iraqi civilians were being wasted and declared May Day a no peace, no work holiday. Angered after supporting Democrats who received a mandate to end the war but who now continue to fund it, longshoremen decided to exercise their political power on the docks.

The Longshore workers have the explicit support of postal workers in New York and San Francisco, and I hope this will be only the beginning of ongoing, widespread industrial action to end a war that political action — even after two election cycles, after hundreds of millions of dollars, after countless hours of lobbying and electioneering, after a change in government, and with the backing of an overwhelming supermajority of the populace — has proven completely incapable of ending.

This is May Day as it is and ought to be. A Day of Resistance against the arrogance and power of bosses, bordercrats, bullies, and the Maters of War, who would harass us, intimidate us, silence us, exploit us, beat us, jail us, deport us, extort us, and do anything else it takes to stop us from coming into our own. A day to celebrate workers’ struggles for dignity, and for freedom, through organizing in their own self-interest, through agitating and exhorting for solidarity, and through free acts of worker-led direct action to achieve their goals, marching under the banners of We are all leaders here and Dump the bosses of your back. A day to remember:

Meanwhile, in the news, some useless idiot is wandering around Washington proclaiming Law Day, accosting hundreds of millions of complete strangers to tell them to put on ceremonies in praise of his own power to do the beating, jailing, deporting, etc. In Istanbul, organized workers marched to Taksim Square in defiance of the Turkish government, which has declared their free assembly illegal, and which has deployed government riot cops to attack them with firehoses and tear gas. In Harare, organized workers are holding rallies today to call attention to the devastating effect of the government’s hyperinflationary money monopoly on workers’ wages–and an apparatchik of the Zimbabwean government–one of the most violently anti-worker governments in the world–is taking the opportunity to wear a concerned expression and assure that Government would at all times endeavour to make sure that workplaces were monitored through inspections to minimize hazards that might injure or kill them. (No word yet on whether the hazards the inspectors will be inspecting for include the Zimbabwe Republic Police or the Central Intelligence Organization.) We must never forget what this band of creeps and fools is doing their best to remind us of — that the State is the most deadly weapon of our enemies, and that it is a weapon that we will never be able to wield for ourselves without chaining ourselves to politics and destroying the very things we meant to fight for.

In this season and in these days, in the midst of Babel during its most raucous festival–when so much of what we see and hear are the endless shouts of professional blowhards who know of no form of social change other than political change, and who know of no site of political change other than the gladiatorial arena of electoral politics, and who seem to know of no form of electoral politics other than polling, horse-trading, and endlessly shouting about a series of nomenklatura-contrived issues, which boil down to little more than a media-facilitated exchange of racist, sexist, ageist, and authoritarian barbs among the nomenklatura-approved serious candidates–it’s important to remember that, in spite of all the noise and spectacle, the most significant events for labor and for human freedom are happening in the streets of cities all over the country and all over the world, where workers are organizing among themselves, demanding their rights, fighting for their lives, and defying or simply bypassing the plutocrats and their so-called laws. In the U.S.A., while the punch-drunk establishmentarian labor movement reels from one failure to another, some of the most dynamic and successful labor struggles in the past few years have been fought by a grassroots union organized along syndicalist lines without NLRB recognition, using creative secondary boycott tactics which would be completely illegal if they had submitted to the regulatory patronage of the Wagner-Taft-Hartley system. There is a lesson here–a lesson for workers, for organizers, for agitators, and anti-statists. One we’d do well to remember when confronted by any of the bosses–whether corporate bosses or political, the labor fakirs and the authoritarian thugs styling themselves the vanguard of the working class, the regulators and the deporters and the patronizing friends of labor all:

Here’s the quote. These are a couple of passages from the final chapters of Paul Buhle’s book, Taking Care of Business: Sam Gompers, George Meany, Lane Kirkland, and the Tragedy of American Labor. They have a lot to say on the logical end-point of establishmentarian unionism and how, within the tripartite planning system of Big Government, Big Business, and Big Labor–particularly after the corporate merger and consolidation known as the AFL-CIO–the top union bosses tacked further and further away from industrial organization towards political organization — in effect, ceasing to be workers’ unions, and instead operating as an enormously wealthy but crumbling and increasingly irrelevant sort of Labor PAC.

The departure of Reuther and the UAW from the AFL-CIO in 1964 not only meant no charismatic personality was left combat meaning but also no block of aggressive unionists to offer significant, concerted resistance to rightward-drifting union leadership and social policies. The executive committee functioned as a glorified rubberstamping agency rather than a representative body. Seen in retrospect, centralization of power was the inner logic of the subsequent institutional consolidation. Neither William Green nor Walter Reuther nor even Samuel Gompers, an expert autocratic manipulator in his day, wielded as much personal control is to Meany and his entourage. One traditional labor historian, admiring the advance of the bureaucracy, put it most politely: labor evidently no longer had any great need for services beyond negotiation and enforcement of existing contracts. Everything else could more safely and efficiently be handled better from above. In December 1977 at the last national convention where Meany played an active role, the only names offered in nomination for president and secretary were Meany and Lane Kirkland. Neither was resistance offered to any of the nominees for the thirty-three vice presidencies. A lone dissident of sorts who did manage to get onto the council, the socialistic machinists’ president, William Winpisinger, was widely regarded as window-dressing for the steady rightward drift. Carefully directing his political views toward the public sphere, Winpisinger restrained his personal criticisms of Meany, much as some socialist craft unionists of the 1910s insisted that Gompers was a symptom and not the cause of labor conservatism, better endured than combated. Meany responded by savaging Winpisinger’s favorite views without mentioning Winpisinger himself.

By the 1970s, Meany grew more candid–or perhaps merely more arrogant. He held his ground proudly against his internal enemies and gleefully watched the mass social movements of the 1960s fade away. Admittedly, he also saw power within the Democratic Party slipped further from his potential grasp and the AFL-CIO fall precipitously by any measurement of size and influence. Asked in 1972 why AFL-CIO membership was thinking as a percentage of the workforce, he responded, I don’t know, I don’t care. When a reporter pressed the issue, Would you prefer to have a larger proportion? Meany snapped, not necessarily. We’ve done quite well without it. Why should we worry about organizing groups of people who do not appear to want to be organized? If they prefer to have others speak for them and make the decisions which affect their lives… that is their right. Asked whether he expected labor’s influence to be reduced, he responded, I used to worry about the… size of the membership…. I stopped worrying because to me it doesn’t make any difference… The organized fellow is the fellow that counts. This is just human nature. Unorganized and lower-paid workers were less-than-irrelevant to Meany; they were unwanted.

Never particularly supportive of strikes except those protecting jurisdictions, Meany became steadily more hostile to walkouts as time went on. (He made one key exception urging political strikes by merit time workers against, of all things, we being loaded onto Russian ships.) In 1970, he observed, where you have a well-established industry and a well-established union, you are getting more and more to the point where strike doesn’t make sense. Rather than strikes and organizing, Meany put his eggs into the basket of electoral campaigns, legislative activity, and involvement in a panoply of government-management-labor commissions and agencies in the Nixon, Ford, and Carter administrations. In some circles these activities actually reinforce the myth of the powerful Meany, labor statesmen and public figure. They did demonstrably little for labor. And no amount of them could quite dispel the image of the narrow-minded unabashedly feminist-baiting and gay-baiting labor boss eating at four-star restaurants and puffing a high-priced class of cigars once restricted to capitalists and mobsters.

The AFL-CIO politicked actively for Jimmy Carter in 1976, after its leaders have expressed their real preference for Scoop Jackson. Ironically, the Georgia Democrat’s narrow margin of victory actually made the support of labor, the African-American community, and feminists, among others, the crucial margin between defeat in victory. Once more, given a different approach, it might have been a moment for the labor movement to flex very real muscles and work for legislative assistance and breaking down barriers to organizing the unorganized, just as the women’s movement reached in early apex and as assorted movements among people of color looked to advances within the mainstream. For that kind of enterprise, however, Meany had no stomach whatever.

Once in office, Carter offered symbols instead of substance: a modest assortment of anti-poverty pilot programs amid a generalized retreat from the Great Society promises. Secretary of Labor Ray Marshall would be remembered not for his speeches saluting labor but because he was the last labor secretary who apparently believed the unions were necessary for working people. As so often, labor had rewarded its friends, gaining little in return. Meany soon let it be known that he was giving Carter a C- as president. Did he wish to see anyone else in the race for 1980? Yes, he shot back, Harry Truman. I wish he were here. To be fair, the old strike-breaking Give ‘Em Hell Harry could not likely have accelerated the growth of American weaponry any faster than Carter did after the Russian invasion of Afghanistan in 1979. He might have bombed Iran into oblivion, and he surely would have sounded tougher. That kind of rhetoric, joined perhaps with robust new liberal-led red-scare against peaceniks, feminists, and radicals at large, would surely have had more appeal to the frustrated, aging bully that Meany had become.

The AFL-CIO issued dire warnings before and after the crucial 1980 election. Union activists worked although with less enthusiasm than anxiety for Carter’s re-election. The aftermath of Reagan’s triumph (by a relatively small margin, it should be remembered, and due to the Iran crisis and the economy rather than any great public fondness for the former California Governor) quickly justified the forebodings. As the new president broke the air controllers’ strike and sent a message to the labor movement both Reagan’s rhetoric and policies proved brutal. The Republican administrations appointees to the National Labor Relations Board notoriously slanted against unions, moved quickly to remove restraints upon opposition to unionization and to all but encourage fresh efforts at decertification. Especially for people of color, disproportionately poor and barely-working class, the prospect of factory shutdowns and worsening health care with few resources was aggravated by their being depicted as the ungrateful recipients of various undue privileges and taxpayer largesse. Union membership fell for an assortment of other reasons as well, but heightened employer resistance stood near the head of the pack. And yet, if labor leaders distrusted or even despise Reagan’s allies, many experienced an unanticipated degree of self realization and hating Reagan’s enemies, those feminists, peaceniks, and assorted left-liberals to assistant to become radio host Rush Limbaugh’s favorite targets.

Besides, labor did have an elusive, thoroughly institutional fallback on the national political stage. In 1981, in the wake of Reagan’s victory, a hard-pressed Democratic National Committee granted the AFL-CIO 25 at-large seats and four out of 35 seats on its executive body. Within a diminished party suffering an early bout of Reaganism (and whose congressional delegation would indeed vote for so many of Reagan’s programs), the AFL-CIO became in return the largest single Democratic financial donor, supplying the DNC with more than a third of its annual budget. The defeat of a modest labor reform bill in Congress in 1978 showed that the conservative counteroffensive had begun in earnest with simultaneous Democratic president and Congress for the last time in at least a generation. Wall Street analysts warned that a new era of militant labor leadership might emerge a political defeat.

Instead, defeat bred timidity and an eagerness to shift foreign of rightward to recuperate the Reagan Democrats. As along with an increasingly unrealistic hope for a major change of labor laws, the specter of protectionism–which labor’s top leaders did not themselves particularly desire–offer the only popular fight-back issue imaginable. In the absence of a real internationalist program of protecting working people across borders, the new protectionism mainly added us mean-spiritedness to organized labor’s perennial self-concern. The downward spiral of labor’s claim to special protection within the liberal coalition thereby lead further and further to its isolation.

Over My Shoulder #4: Paul Buhle’s Taking Care of Business: Samuel Gompers, George Meany, Lane Kirkland, and the Tragedy of American Labor

Paradoxically and simultaneously, industrial unionism–though born of the radicalism of Toledo, Minneapolis, and San Francisco–became a new mode of enforcing the contract. Attempts to seize back the initiative from foremen and time-study experts were met, now, with directives from industrial union leaders to stay in line until a greivance could be properly negotiated. Soon, union dues would be deducted automatically from wages, so that officials no longer needed to bother making personal contact and monthly appeals to the loyalty of members.

Meany, treating industrial unionists at large as enemies, could not for many years grasp that events were bringing the CIO’s elected officials closer to him. He was steeped in a craft tradition to which the very idea of workers united into a single, roughly roughly egalitarian body hinted at revolutionary transformation. But many less conservative sectors were equally surprised by the course of the more democratic CIO unions toward the end of the 1930s. A triangle of government, business, and labor leadership brought about a compact that served mutual interest in stability, though often not in the interests of the workers left out of this power arrangement.

Not until 1937 did business unionism confirm its institutional form, when the Supreme Court upheld the Wagner Act. Now, a legitimate union (that is to say, a union legitimated by the National Labor Relation Board) with more than 50 percent of the vote in a union election became the sole bargaining agent for all. Unions stood on the brink of a membership gold-rush. The left-led Farm Equipment union could that same year, for instance, win a tremendous victory of five thousand workers at International Harvester in Chicago without a strike, thanks to the NLRB-sanctioned vote. But union leaders also prepared to reciprocate the assistance with a crackdown against membership indiscipline. The United Auto Workers, a case in point, arose out of Wobbly traditions mixed with a 1920s Communist-led Auto Workers Union and an amalgam of radicals’ efforts to work within early CIO formations. The fate of the industry, which fought back furiously against unionization, was set by the famed 1937 sit-down strikes centered in Flint, which seemed for a moment to bring the region close to class and civil war. Only the personal intercession of Michigan’s liberal Governor Murphy, it was widely believed, had prevented a bloodbath of employers’ armed goons retaking the basic means of production and setting off something like a class war. Therein lay a contradiction which the likes of George Meany could appreciate without being able to comprehend fully. The notorious willingness of UAW members to halt production until their greivances were met did not end because the union had employed the good offices of the goveronr (and the appeals of Franklin Roosevelt) to bring union recognition. On the one hand, a vast social movement of the unemployed grew up around the auto workers’ strongholds in Michigan, generating a sustained classwide movement of employed and unemployed, lasting until wartime brought near full employment. On the other hand, union leaders, including UAW leaders, swiftly traded off benefits for discipline in an uneven process complicated by strategic and often-changing conflicts within the political left.

The continuing struggle for more complete democratic participation was often restricted to the local or the particularistic, and thanks to a long-standing tradition of autonomy, sometimes to insular circles of AFL veterans. For instance, in heavily French-Canadian Woonsocket, Rhode Island, a vibrant Independent Textile Union had sprung up out of a history of severe repression and the riotous 1934 general textile strike. The ITU remained outside the CIO and set about organizing workers in many industries across Woonsocket; then, after a conservatizing wartime phase, it died slowly with the postwar shutdown of the mills. To take another example, the All Workers Union of Austin, Minnesota–an IWW-like entity which would reappear in spirit during the 1980s as rebellious Local P-9 of the United Food and Commercial Workers–held out for several years in the 1930s against merger. A model par excellence of horizontal, unionism with wide democratic participation and public support, the AWU (urged by Communist regulars and Trotskyists alike) willingly yielded its autonomy, and in so doing also its internal democracy, to the overwhelming influence of the CIO. In yet another case, the Progressive Miners of America, which grew out of a grassroots rebellion against John L. Lewis’s autocratic rule, attempted to place itself in th AFL that Lewis abandoned, on the basis of rank-and-file democracy with a strong dose of anti-foreign and sometimes anti-Semitic rhetoric. Or again: the AFL Seaman’s Union of the Pacific, reacting ferociously to Communist efforts to discipline the sea lanes, stirred syndicalist energies and like the PMA simultaneously drew upon a racist exclusionary streak far more typical of the AFL than the CIO.

These and many less dramatic experiments died or collapsed into the mainstream by wartime. But for industrial unionism at large, the damage had already been done to the possibilities of resisting creeping bureaucratization. Indeed, only where union delegates themselves decreed safety measures of decentralization, as in the UAW in 1939 (against the advice of Communists and their rivals), did conventions emerge guaranteeing participation from below, to some significant degree.

Free The Unions (and all political prisoners)

Today is May Day, or International Worker’s Day: an international day for celebrating the achievements of workers and the struggle for organized labor.

You might have thought that the proper day was Labor Day, as traditionally celebrated on the first Monday in September. Not so; the federal holiday known as Labor Day is actually a Gilded Age bait-and-switch from 1894. It was crafted and promoted in an effort to throw a bone to labor while erasing the radicalism implicit in May Day (a holiday declared by workers, in honor of the campaign for the eight hour day and in memory of the Haymarket martyrs). As a low-calorie substitute for workers’ struggle to come into their own, we get a celebration of labor … so long as it rigidly adheres to the AFL-line orthodoxy of collective bargaining, appeasement, and power to the union bosses and government bureaucrats. That this holiday emerged and solidified at exactly the same historical moment as the unholy alliance of conservative (statist, nativist, racist, and misogynist) unionism with corporate barons and the Progressive regulation movement is no coincidence. That AFL-line unions continue to use Labor Day as a chance to co-opt the historic successes of radical, libertarian unions in campaigns such as the fight for the eight-hour day or the five-day week is no coincidence, either.

Too many of my comrades on the Left fall into the trap of taking the Labor Day version of history for granted: modern unions are trumpeted as the main channel for the voice of workers; the institutionalization of the system through the Wagner Act and the National Labor Relations Board in 1935, and the ensuing spike in union membership during the New Deal period, are regarded as one of the great triumphs for workers of the past century.

You may not be surprised to find out that I don’t find this picture of history entirely persuasive. The Wagner Act was the capstone of years of government promotion of conservative, AFL-line unions in order to subvert the organizing efforts of decentralized, uncompromising, radical unions such as the IWW and to avoid the previous year’s tumultuous general strikes in San Francisco, Toledo, and Minneapolis. The labor movement as we know it today was created by government bureaucrats who effectively created a massive subsidy program for conservative unions which followed the AFL and CIO models of organizing–which emphatically did not include general strikes or demands for worker ownership of firms. Once the NRLB-recognized unions had swept over the workforce and co-opted most of the movement for organized labor, the second blow of the one-two punch fell: government benefits always mean government strings attached, and in this case it was the Taft-Hartley Act of 1947, which pulled the activities of the recognized unions firmly into the regulatory grip of the federal government. Both the internal culture of post-Wagner mainstream unions, and the external controls of the federal labor regulatory apparatus, have dramatically hamstrung the labor movement for the past half-century. Union methods are legally restricted to collective bargaining and limited strikes (which cannot legally be expanded to secondary strikes, and which can be, and have been, broken by arbitrary fiat of the President). Union hiring halls are banned. Union resources have been systematically sapped by banning closed shop contracts, and encouraging states to ban union shop contracts–thus forcing unions to represent free-riding employees who do not join them and do not contribute dues. Union demands are effectively constrained to modest (and easily revoked) improvements in wages and conditions. And, since modern unions can do so little to achieve their professed goals, and since their professed goals have been substantially lowered anyway, unionization of the workforce continues its decades-long slide.

May Day is a celebration of the original conception of the labor movement, as expressed by anarchist organizers such as Albert Parsons, Lucy Parsons, Benjamin Tucker, and others: a movement for workers to come into their own, by banding together, supporting one another, and taking direct action in the form of boycotts, work stoppages, general strikes, and the creation of workers’ spaces such as local co-operatives and union hiring halls. The spirit was best expressed by John Brill’s famous exhortation to Dump the bosses off your back–by which he did not mean to go to a government mediator and get them to make the boss sit down with you and work out a slightly more beneficial arrangement. Dump the bosses off your back! meant: organize and create local institutions that let you bypass the bosses. Negotiate with them if it’ll do some good; ignore them if it won’t. The signal achievements of the labor movement in the late 19th and early 20th century were achievements in this spirit: the campaigns that won the 8 hour day and the weekend off in many workplaces, for example, emerged from a unilateral work stoppage by rank-and-file workers, declared by the Federation of Organized Trades and Labor Unions, and organized especially by the explicitly anarchist International Working People’s Association, after legislative efforts by the National Labor Union and the Knights of Labor failed. The stagnant, or even backsliding, state of organized labor over the past half century is the direct result of government colonization and the ascendency of government-subsidized unions.

Don’t get me wrong: the modern labor movement, for all its flaws and limitations, is the reflection (no matter how distorted) of an honorable effort; it deserves our support and does some good. Union bosses, corporate bosses, and government bureaucrats may work to co-opt organized labor to their own ends, but rank-and-file workers have perfectly good reasons to support AFL-style union organizing: modern unions may not be accountable enough to rank-and-file workers, but they are more accountable than corporate bureaucracy; modern unions bosses don’t care enough about giving workers direct control in their own workplace, but they care more than corporate bosses, who make most of their living by denying workers such control. The labor movement, like all too many other honorable movements for social justice in the 20th century, has become a prisoner of politics: a political situation has been created in which the most rational thing for most workers to do is to muddle through with a co-opted and carefully regulated labor movement that helps them in some ways but undermines their long-term prospects. It doesn’t make sense to respond to a situation like that with blanket denunciations of organized labor; the best thing to do is to support our fellow workers within the labor movement as it is constrained today, but also to work to change the political situation that constrains it, and to set it free. That means loosening the ties that bind the union bosses to the corporate and government bureaucrats, by working to repeal the Taft-Hartley Act, and abolish the apparatus of the NLRB, and working to build free, vibrant, militant unions once again.

Dump the bosses off your back. Free the unions, and all political prisoners!

Update (2007-04-19): For a long time this post incorrectly attributed the song Dump the Bosses Off Your Back to Joe Hill, the legendary songwriter and organizer for the Industrial Workers of the World. Although it is very similar in style to Hill’s songs — it sets a radical message in simple language to the melody to a popular hymn — the song was actually written by John Brill, another Wobbly songwriter. The song first appeared in the Joe Hill Memorial (9th) edition of the IWW songbook, released in March 1916, four months after Joe Hill was hanged by the state of Utah.
