Disobey Day

A very happy MLK Monday to you all. I hear that there is some spectacle of pomp, power, ritualized violence, and safely quarantined content-less liberal admiration going on; which is too bad. Today should be a happy occasion. You can celebrate Disobey Day to-day by using your day off to celebrate the true legacy of the Freedom Movement, to forget the coronation ceremony, to break an unjust law, to tell an unpopular truth, or to disobey an illegitimate authority.

It seems to me that if the only way you can get official national hero types is by oversimplifying, lying, and thus eviscerating the substance of a world-changing life of work and body of thought, then official national hero types are worth less than nothing. What interest do they serve, and what are we supposed to need them for?

Certainly not the interest of honesty, or truth, and it seems to me that in these times those are coins far rarer — and therefore far more dear — than the pompous deliveries of the cosseted clique of power-tripping politicians and professional blowhards, who have convinced themselves that their collective in-jokes, shibboleths and taboos constitute the public life of a nation. I don't give much of a damn, in the end, whether or not King gets ritualistically name-checked by men and women who were or would have been his mortal enemies to make stentorian speeches supposedly on his behalf. What I give a damn about is what the man, for all his many faults, actually cared about, fought for, and died for: the struggle of ordinary men and women for their own freedom, which meant their struggle to defy, resist, or simply bypass the consolidated violence of the belligerent power-mongers and the worse-than-useless moderate hand-wringers who made their living peddling excuses, apologetics, and the endless counsel of wait, wait.

This, not public-school pageants and official national hero types, is what the vast majority of us, who get no profit from the fortunes of the political-intellectual complex and its pantheon, need . . . .

Happy Lysander Spooner Day!

To-day — 19 January 2013 — is the 205th birthday of the militant abolitionist, philosopher and individualist anarchist Lysander Spooner (b. 19 January 1808, Athol, Massachusetts; d. May 14, 1887, Boston, Massachusetts). In honor of his life and work, the Ministry of Culture in this secessionist republic of one is happy to once again mark to-day as Lysander Spooner Day.

This is from Spooner’s first letter to Thomas F. Bayard: Challenging His Right — and That of All the Other So-Called Senators and Representatives in Congress — To Exercise Any Legislative Power Whatever Over the People of the United States.

1. No man can delegate, or give to another, any right of arbitrary dominion over himself; for that would be giving himself away as a slave. And this no one can do. Any contract to do so is necessarily an absurd one, and has no validity. To call such a contract a !!!@@e2;20ac;2dc;Constitution,' or by any other high-sounding name, does not alter its character as an absurd and void contract.

2. No man can delegate, or give to another, any right of arbitrary dominion over a third person; for that would imply a right in the first person, not only to make the third person his slave, but also a right to dispose of him as a slave to still other persons. Any contract to do this is necessarily a criminal one and therefore invalid. To call such a contract a !!!@@e2;20ac;2dc;Constitution' does not at all lessen its criminality, or add to its validity.

These facts, that no man can delegate, or give away, his own natural right to liberty, nor any other man’s natural right to liberty, prove that he can delegate no right of arbitrary dominion whatever–or, what is the same thing, no legislative power whatever–over himself or anybody else, to any man, or body of men.

. . . All this pretended delegation of legislative power—that is, of a power, on the part of the legislators, so-called, to make any laws of their own device, distinct from the law of nature—is therefore an entire falsehood; a falsehood whose only purpose is to cover and hide a pure usurpation, by one body of men, of arbitrary dominion over other men.

. . . For all the reasons now given, and for still others that might be given, the legislative power now exercised by Congress is, in both law and reason, purely personal, arbitrary, irresponsible, usurped dominion on the part of the legislators themselves, and not a power delegated to them by anybody.

Yet under the pretense that this instrument gives them the right of an arbitrary and irresponsible dominion over the whole people of the United States, Congress has gone on, for ninety years and more, filling great volumes with laws of their own device, which the people at large have never read, nor even seen nor ever will read or see; and of whose legal meanings it is morally impossible that they should ever know anything. Congress has never dared to require the people even to read these laws. Had it done so, the oppression would have been an intolerable one; and the people, rather than endure it, would have either rebelled, and overthrown the government, or would have fled the country. Yet these laws, which Congress has not dared to require the people even to read, it has compelled them, at the point of the bayonet, to obey.

And this moral, and legal, and political monstrosity is the kind of government which Congress claims that the Constitution authorizes it to impose upon the people.

Sir, can you say that such an arbitrary and irresponsible dominion as this, over the properties, liberties, and lives of fifty millions of people–or even over the property, liberty, or life of any one of those fifty millions–can be justified on any reason whatever? If not, with what color of truth can you say that you yourself, or anybody else, can act as a legislator, under the Constitution of the United States, and yet be an honest man?

. . . I trust I need not suspect you, as a legislator under the Constitution, and claiming to be an honest man, of any desire to evade the issue presented in this pamphlet. If you shall see fit to meet it, I hope you will excuse me for suggesting that — to avoid verbiage, and everything indefinite — you give at least a single specimen of a law that either heretofore has been made, or that you conceive it possible for legislators to make–that is, some law of their own device–that either has been, or shall be, really and truly obligatory upon other persons, and which such other persons have been, or may be, rightfully compelled to obey.

If you can either find or devise any such law, I trust you will make it known, that it may be examined, and the question of its obligation be fairly settled in the popular mind.

But if it should happen that you can neither find such a law in the existing statute books of the United States, nor, in your own mind, conceive of such a law as possible under the Constitution, I give you leave to find it, if that be possible, in the constitution or statute book of any other people that now exist, or ever have existed, on the earth.

If, finally, you shall find no such law, anywhere, nor be able to conceive of any such law yourself, I take the liberty to suggest that it is your imperative duty to submit the question to your associate legislators; and, if they can give no light on the subject, that you call upon them to burn all the existing statute books of the United States, and then to go home and content themselves with the exercise of only such rights and powers as nature has given to them in common with the rest of mankind.

And this is from No. 6 (The Constitution of No Authority) of his most famous pamphlet series, No Treason

The payment of taxes, being compulsory, of course furnishes no evidence that any one voluntarily supports the Constitution. . . . [T]his theory of our government is wholly different from the practical fact. The fact is that the government, like a highwayman, says to a man: Your money, or your life. And many, if not most, taxes are paid under the compulsion of that threat.

The government does not, indeed, waylay a man in a lonely place, spring upon him from the road side, and, holding a pistol to his head, proceed to rifle his pockets. But the robbery is none the less a robbery on that account; and it is far more dastardly and shameful.

The highwayman takes solely upon himself the responsibility, danger, and crime of his own act. He does not pretend that he has any rightful claim to your money, or that he intends to use it for your own benefit. He does not pretend to be anything but a robber. He has not acquired impudence enough to profess to be merely a "protector," and that he takes men's money against their will, merely to enable him to "protect" those infatuated travellers, who feel perfectly able to protect themselves, or do not appreciate his peculiar system of protection. He is too sensible a man to make such professions as these. Furthermore, having taken your money, he leaves you, as you wish him to do. He does not persist in following you on the road, against your will; assuming to be your rightful "sovereign," on account of the "protection" he affords you. He does not keep "protecting" you, by commanding you to bow down and serve him; by requiring you to do this, and forbidding you to do that; by robbing you of more money as often as he finds it for his interest or pleasure to do so; and by branding you as a rebel, a traitor, and an enemy to your country, and shooting you down without mercy, if you dispute his authority, or resist his demands. He is too much of a gentleman to be guilty of such impostures, and insults, and villanies as these. In short, he does not, in addition to robbing you, attempt to make you either his dupe or his slave.

And this is from the end of the same pamphlet:

Inasmuch as the Constitution was never signed, nor agreed to, by anybody, as a contract, and therefore never bound anybody, and is now binding upon nobody; and is, moreover, such an one as no people can ever hereafter be expected to consent to, except as they may be forced to do so at the point of the bayonet, it is perhaps of no importance what its true legal meaning, as a contract, is. Nevertheless, the writer thinks it proper to say that, in his opinion, the Constitution is no such instrument as it has generally been assumed to be; but that by false interpretations, and naked usurpations, the government has been made in practice a very widely, and almost wholly, different thing from what the Constitution itself purports to authorize. He has heretofore written much, and could write much more, to prove that such is the truth. But whether the Constitution really be one thing, or another, this much is certain – that it has either authorized such a government as we have had, or has been powerless to prevent it. In either case, it is unfit to exist.

December 17th is the International Day to End Violence Against Sex Workers

December 17th, 2012 is the 10th annual International Day to End Violence Against Sex Workers. From December17.org:

December 17th is the International Day to End Violence Against Sex Workers. This event was created to call attention to crimes committed against sex workers all over the globe. Originally conceptualized by Annie Sprinkle and initiated by the Sex Workers Outreach Project USA as a memorial and vigil for the victims of the Green River Killer in Seattle Washington, the International Day to End Violence Against Sex Workers has empowered workers from cities around the world to come together and organize against discrimination and remember victims of violence. During the week of December 17th, sex worker rights organizations and their allies stage actions and vigils to raise awareness about violence that is commonly committed against sex workers. The assault, battery, rape and murder of sex workers must end. Existing laws prevent sex workers from reporting violence. The stigma and discrimination that is perpetuated by the prohibitionist laws has made violence against us acceptable. Please join with sex workers around the world and stand against criminalization and violence committed against our communities.

The commemoration began from the Sex Workers' Outreach Project's memorial and vigil for the victims of the Gary Ridgway, the Green River Killer. Since then its purpose has expanded to a memorial for, and protest against, all forms of violence against women in prostitution and elsewhere in the sex industry.

I'm opposed to prostitution as an industry, on radical feminist grounds. I frankly have very deep and sharp differences with the organizers of the event, and I'm iffy at best towards the rhetorical framework of sex work as a whole, for reasons that are way beyond the point of this post. But so what? The day is an important one no matter what differences I may have with the organizers. Real steps towards ending the ongoing daily violence against women in prostitution and elsewhere in the sex industry are more important than that; here as much as anywhere — probably more than anywhere else — women's lives are at stake.

… A serious commitment to freedom for, and an end to violence against, women means a serious commitment to end violence against women in the sex industry. All of it. Now and forever. … And ending violence against women in prostitution also means ending State violence against women in prostitution. All of it. Law enforcement comes from the barrel of a gun, and criminalizing women in prostitution means authorizing cops to attack them. Ending violence against women means decriminalization of prostitution; it means an end to cops, guns, clubs, cuffs, jail for women who are just trying to get by in peace. It means an end to the misogynist audacity of conservative pols who use violence against women in prostitution as one of the primary excuses for attacking those women with the sword of the Law.

Any serious commitment to freedom for, and an end to violence against, women, means a serious commitment to ending violence against women who work in the sex industry. All of it. And that means any kind of violence, whether rape, or assault, or robbery, or abduction, or confinement against her will, or murder. No matter who does it. The one image of violence against sex workers that the malestream media never tires of repeating is the roving madman, cutting women down in the streets. But roving madmen come in a lot of shapes and sizes and uniforms. It may be a serial killer. But it may be a pimp. Or a trafficker. Or a john who imagines that paying for sex means he owns a woman’s body. Or, lest we forget, it may be a cop who believes that his badge, and his victim’s status in the system of patriarchal sex-class, makes absolutely any kind of sexual predation or physical torture a cop’s prerogative and nothing better than what the victim deserves. Or, lest we forget, a cop or a prosecutor or an immigration control freak, who calls the violence of an assault, restraint, and involuntary confinement an arrest or a sentence under the color of The Law. The Law has no more right than anyone else to hurt women or shove them around.

No matter who does it, this kind of violence — violence against peaceful people whose work, whatever you think of it, is honest work for willing customers, and is a way to get by, and doesn’t do one thing to threaten or violate the rights of a single living soul — violence against women who are made vulnerable by the violence and the killing indifference of the State — violence against women practiced in the name of enforcing patriarchal sex-class and misogynistic hatred for overtly sexual women — is wrong, absolutely wrong, and it has to stop. Immediately, completely, and forever.

Grassroots Expansion for Red Emma’s in Baltimore

In Baltimore, Red Emma’s has some big plans, and they are looking for some grassroots support to build out their worker-owned radical bookstore, café and community space.

Here’s more from the Red Emma’s collective, via IndieGogo. As you may know, one of the harshest restraints on most worker-owned shops, co-ops and radical spaces are the extreme difficulties they have in paying for maintenance and expansions — you need resources to expand but you need to expand to get access to resources, and it’s hard to get bank loans, credit, or any other form of capitalization when you don’t look like a traditional corporate capitalist enterprise. That doesn’t mean it can’t be done but it does mean if it’s going to happen it largely depends on us and our networks to step up and put up the mutual support for the kinds of radical spaces that we want to see, that their institutions won’t fund. Anyway, the campaign is running now over at IndieGoGo, and any support you can send their way will really help with what sounds like some really awesome plans.

After 8 years in the storefront at 800 Saint Paul, Red Emma’s has decided it’s time to move: our current space just isn’t big enough to hold all the things we want to collectively make it do.

Over the past eight years, we’ve hosted a thousand public events, created two new radical spaces (2640 and the Baltimore Free School), organized international conferences, built an amazing annual radical bookfair, and served as a hub knitting together Baltimore’s different politically engaged communities, all the while keeping a collectively-owned and operated business open just about 365 days a year.

… We’ve just signed a lease for the fall of 2013; located at 30 West North Avenue, next door to Liam Flynn’s Ale House (itself started by founding Red Emma’s collective members!), the new space will be over five times the size of our current location.

We’ll be expanding our food operation to a full kitchen, moving beyond our current limited cafe menu to really let some of the culinary talent we’ve got in the collective shine. And we’ll be doing this in a way that makes extensive use of locally sourced agricultural products while keeping prices affordable: healthy, sustainable food should be the norm, not a luxury. We’ll be increasing the footprint of our bookstore sixfold—space constraints alone have prevented us from building the world class selection we’ve dreamed of, and the new space will make it possible to really build the kind of radical bookstore Baltimore deserves.

… The space is going to be far more welcoming; not only are we going to vastly expand the number of seats, we’ll also be full-accessible in the new space … And most importantly, scaling up is going to let us do something we’ve always dreamt of: pay the people working on the project a living wage. Our current storefront has never been big enough to reach the economies of scale we would have needed to keep funding our political mission and also pay ourselves something sustainable for the long-term; most of us work on a volunteer basis right now, and those of us who do get paid don’t get much. With the new space, our plan is to start with a living wage and work our way up from there.

Our plan and your help

Between renovations, equipment purchases, licensing, and other fees, we need roughly $250,000 to open this new space; we’re hoping to raise at least $50,000 through crowdfunding on this site, but the more we can raise here the less debt we will start off with in the new space. While the funds we raise here and elsewhere are crucial, there’s going to be all sorts of opportunities to pitch in to help us get the new space off the ground in other ways as we get closer to opening.
